DM Scuba Training - Bookings, Terms and Conditions
Bookings: All bookings are subject to these terms and conditions. All activities are subject to availability. DM Scuba Training (“We”) may accept or decline bookings, and may withdraw any offer discount or promotion (including our package pricing) at any time, in our absolute discretion. Your booking shall only be accepted when DM Scuba Training have received the amounts due upon booking from you, and have issued you with written acceptance via email of your booking.
Pricing, offers, discounts and promotions: Price isn't everything - with DM Scuba Training you know you will be diving with a professional and fully insured school, where we aim to deliver training and support which is second to none, enabling you to be the best diver you can be. However, we also appreciate that price is important to you. That's why we offer package prices for certain courses, and from time to time we may offer special discounts and promotions. Each offer, discount or promotion (including our package pricing) cannot be used in conjunction with any other DM Scuba Training offer, discount, or promotion; or in conjunction with quoted price. You must identify the applicable offer, discount or promotion (including our package pricing) at the time of booking. We may issue you with a quotation from time to time. Such quotations shall be valid for seven days unless a shorter period is specified by DM Scuba Training, and shall not constitute an offer. Unless an offer, discount or promotion (including our package pricing) is claimed at the time of booking, or otherwise agreed in writing by DM Scuba Training, our standard website prices as set out on the date of your booking shall apply.
Course costs: All course costs are displayed on the web page of the relevant course.
Information for all Courses: DM Scuba reserves the right to refuse admission onto a course or courses. In the absence of any negligence by DM Scuba, or its employees, participation in diving training is undertaken entirely at your own risk. DM Scuba or its staff cannot accept responsibility for any injury or other loss caused by, or resulting from, your own conduct, which amounts to your own contributory negligence. Candidates agree to abide by the rules of DM Scuba in all diver training matters. The decision of DM Scuba Instructors shall be final in respect of any and all diving and or training matters. Course completion will only be met if the students completes all of the requirements set out by the diving agency.
DM Scuba equipment: Scuba equipment required for all advertised DM Scuba courses is included in the price of the course (Except professional level courses) Candidates using DM Scuba’s equipment for any course are responsible for that equipment and will be charged for any loss or damage caused by student negligence. A Buoyancy Control Device (BCD) will be worn during all in-water scuba activities.
Any equipment damage or loss caused by the student must be paid for prior to any certification being processed or by the end of the course at current retail rates.
Own Equipment Use Policy: Any Diver using their own Scuba equipment must sign and confirm that they have completed a pre-dive safety check of all of their own equipment and that it has been serviced in accordance with the appropriate equipment supplier's service schedule and that any personal air cylinders they are using have also been tested in line with statuary requirements under any required local regulations
Payment: Payment for any course or activity costing less than £150 is due in full upon booking, unless otherwise agreed by DM Scuba Training in writing with you. For all other non-professional courses or activities, a 50% part payment is required at the time of booking and final payment is required upon the date of your course. A part payment of £150 is required for all professional level courses and final payment upon the date of your course starting. All payments are non-refundable, save as set out in these terms and conditions. We accept cheque, cash, direct bank transfer, PayPal and card payments in person.
Cancellations: As DM Scuba only teach very small instructor to student ratios and normally one-on-one in Open Water and in very small groups in the pool, we still incur costs if courses are cancelled as we've turned down other work due to your booking, staff, pool and open waters sites are already booked and we may have distributed course materials to you (if applicable). This is why all deposit payments are non-refundable.
For Discover Scuba Pool Try Dives and Scuba Reviews if you can give us enough notice (minimally a week) and we can fill your space, we will re-arrange your session to the next available slot we have. For all other courses if you cancel later than one calendar month prior to it's start, any materials you have received not covered by your non-refundable deposit must be paid for including a £25 admin fee regardless of the course booked. Within a month (up to a week) of the course start date, 50% of the course cost is payable plus any materials issued. Anytime within 7 days of the course starting date, no refunds will be made.
If any student decides to cancel the course midway or doesn't show up on any agreed / booked dates, no refund of any money already paid will be made. Any further re-scheduled dates will be payable at our standard advertised rates.
Please note COVID cancellations: As Covid is now here to stay and has the same affects as the flu or a cold we cannot make any further allowances for anyone who cancels a course due to catching the virus. Our standard cancellation policy above now applies.
Try before you buy! We highly recommend completing a Pool Discover Scuba Session before booking up to a full certification course to make sure you like it first.
If DM Scuba Training have to cancel a course due to circumstances completely out of our control, either natural (e.g. weather) or governmental (e.g. pandemic lockdowns) then we shall re-schedule the course at the next available date at no additional cost. If you choose not to continue the course due to our cancellation then a full refund or a partial refund for the part not taken will be made (excluding any materials already distributed).
Required documentation: You will be required to complete certain documentation in advance of any activities, and for diving activities you may be required to declare any known medical conditions to DM Scuba Training. You must do so truthfully, accurately, and completely; and must update us if you become aware of any change in the information which you have provided to us.
Course materials: When we accept your booking, we will provide you via electronic eLearning (by post at cost, or upon collection, at your election) with any required course materials which are included in your course fee. Course fees exclude the cost of any additional material like DVDs or online access to materials. We may on certain courses provide a copy of the appropriate DVD if available or your course on loan, unless you elect to purchase your own copy.
Dates and rescheduling: We may agree specific dates for your booking. If we need to reschedule your booking or any portion of your booking (including without limitation due to adverse weather or any other condition making the planned activity unsafe) we will contact you giving as much notice as is possible to provide alternative dates. We may also elect to cancel your booking in full through no fault of your own, in which case we shall refund any payments which you have made in full for the parts cancelled.
Customer rescheduling: Unless otherwise agreed in writing by DM Scuba Training, you may not cancel a booking. However, you may reschedule your booking on no less than thirty days’ notice to us, provided that you complete the activity booked within one year of your initial scheduled date. Upon receipt of your request to reschedule, we will provide you with alternative dates for your selection.
If you are otherwise unable to attend on time or complete your assigned sessions in full in a manner which meets the course requirements within 12 months (including without limitation failure to meet any performance requirements set by the training agency, or being unfit to dive), full payment remains due and payable. Your original session will either be rescheduled, or an additional session added to your course accordingly. You may be required to pay any resulting additional charges for costs to be incurred by DM Scuba Training (including without limitation pool fees, site entrance fees, staff time, transportation costs) prior to such rescheduling or addition of an additional session. If you fail to pay such additional costs as required, but otherwise make payment in full, you may cancel the remainder of your course and DM Scuba Training will issue a referral document so that you can complete your training with another provider. Referral documents are valid for twelve months from completion of the last course component listed in that document.
Course expulsion: We may cancel your booking with immediate effect and without refund if you fail to complete any required documentation, if we become aware that the information that you have provided is incorrect or you have failed to disclose a known medical condition, if you fail to comply with the reasonable instructions of DM Scuba Training including without limitation those relating to safety, or act in any manner which may compromise the health and safety of yourself or others.
Entire Agreement: These terms and conditions form the entire agreement between us in respect of any booking, and exclude all other terms and conditions. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty which is not set out in these terms and conditions. No variation to these terms and conditions shall be effective unless signed in writing by DM Scuba Training. Nothing in these terms or conditions affects your statutory rights, or excludes or limits liability to a greater extent than permitted by applicable law.
Applicable law: These terms and conditions, their subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction in relation to any dispute or claim concerning these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).
